Canada Immigration Rules Changes

Planning to migrate to Canada after January 1 and with children above 19 years, then they need to make separate applications. At present children under 22 are considered as the dependent children and they will automatically get qualify to migrate with parents, if the application of the parents’ for permanent residency is granted.

Under the new scheme, children who past their 19th birthday have to apply with a separate application, by opening a fresh immigration application file along with permanent residency being issued or denied by checking the merits of the application. With work and education experience being a major aspect in the points test for giving permission to emigrate, new rule will make it nearly impossible for new applications to be permitted at last till the third-level education and employment experience build up the required points.

“These rule changes are going to make it a lot harder for parents who have older children to move here,” Dev Patel, an immigration consultant and paralegal based in Mississauga, Ontario, told Gulf News. “This rule change was announced about a month ago and I am already seeing a spike in files and people wanting to come to Canada are worried. I think that it’s important to spread the news that if you plan to move to Canada, the earlier the better. I know that Dubai and the UAE is often used as a stepping stone for many people from the sub-continent who want to come to Canada. I have several files on my desk right now and two families in Dubai will have to make separate files for their older children if they don’t follow through on the current paperwork.”

“The earlier in life immigrants arrive, the more their educational experience will resemble that of their Canadian-born counterparts and the easier it will be to learn an official language and adapt to Canadian cultural traits and social norms,” a says.

Canada Experience Class (cec)

A temporary foreign student or a foreign worker, who finished graduation in Canada, will often have qualities which can make a successful move from temporary residence to permanent residence. The candidate must be familiar with the Canadian society and should be able to contribute to the Canadian economy. You should have knowledge of English or French and qualifying work experience.

The candidate should meet the minimum basic requirements to apply for a permanent residence under the Canadian Experience Class. The requirements are as mentioned below:
  • Prepare to stay outside of the Quebec province
  • Should be either
1) A temporary overseas worker with minimum two years of full-time skilled work experience or an equivalent work experience in Canada or
2) An overseas graduate from Canadian post-secondary university with minimum one year of full-time skilled work experience or an equivalent work experience in Canada

Should have gained work experience in Canada with proper study or work authorization

Can apply while you are employing in Canada or within one year after leaving your job in Canada

Include result of independent language test along with the application. This is from an agency designated by Citizenship and Immigration Canada (CIC)

Skilled work experience meaning according to the Canadian National Occupational Classification (NOC) is,
  • Skill Type 0 Managerial Occupations or
  • Skill Level A Professional Occupations or
  • Skill Level B Technical Occupations and Skilled Trades
The candidate’s application will be evaluated on two major requirements if they are applying as a temporary foreign worker:
  •  Work Experience
  • The ability in French or English
If the candidate is applying as a graduate of Canadian post-secondary educational institution along with a Canadian work experience, this is evaluated using the above requirements, and also the below mentioned one:
  • Education
Main Applicant

If the main applicant is married or living along with a common-law partner in Canada, and if he/she is also meeting the above requirements, then the applicant can think and decide which one among you will apply for an Canadian Experience Class as a main applicant.

Temporary Worker Requirements

As a temporary foreign worker, the candidate should have two years of full-time work experience or an equivalent work experience in Canada. The work experience should be acquired within three years after applying.

Documents that are required to apply for a Canada Experience Class
  • A valid passport
  • Documents showing educational qualification
  • Documents related to employment
  • Police certificate
  • Medical certificate
  • Documents to prove language proficiency, English or French

The applicant should meet minimum level of CLB 5, either in English or French for all four areas of language abilities. If not meeting the minimum language skills, the application can be refused. A language test should be taken from an approved agency by CIC and the result should be included at the time of applying. There is no other way to show language proficiency. The office will check the test results that are provided when you apply.

Education credential requirements

The proof of the applicants’ education is needed with your application. Specifically needs are:
  • A proof showing at least one year of post-secondary education 
  •  A proof that you are in good standing at least one year while attending a postsecondary institution
The proof of education can be in the form of transcripts, a letter of good standing, or diploma or certificate or degree.

Evaluation
